PRIVACY POLICY N-ABLE CLOUD CONSULTANCY & TRAINING BV (HEREINAFTER: N-ABLE)

INTRODUCTION

  • The purpose of this privacy policy is to explain to you what we do with your personal data, whether we help you find a job, continue our relationship with you after we find a position for you, you apply for a job with us, provide you with a service, receive a service from you, use your data to request assistance from you regarding one of our Candidates or you visit our website.
  • It describes how we collect, use and process your personal data and how we meet our legal obligations to you in doing so. Your privacy is important to us and we are committed to protecting and safeguarding your data privacy rights.
  • This privacy policy applies to the personal data of our Candidates, Clients, Suppliers and Website users.
  • It is important to note that it is possible that we may change this privacy policy from time to time.

 

WHAT PERSONAL INFORMATION DO WE COLLECT?

The information described below is, of course, in addition to any personal data we are legally required to process in any situation.

  • CANDIDATE DETAILS:

Depending on the relevant circumstances, we may, among other things, collect some or all of the information listed below to ensure that we can offer you orders or services tailored to your circumstances and interests.

  1. Name;
  2. Date of birth;
  3. Gender;
  4. Photo;
  5. Marital status;
  6. Contact details;
  7. Training details;
  8. Employment history;
  9. Reference details;
  • Immigration status (whether or not you need a work permit);
  • Nationality/citizenship/place of birth;
  • A copy of your driver's license and/or passport/identity card (these documents are not stored digitally);
  • Citizen Service Number (or equivalent) and other tax-related information;
  • Details on pricing etc;
  • Information about your interests and needs regarding future work, both collected directly and indirectly;
  • Additional information you tell us;
  • IP address;
  • CLIENT DATA:

In fact, the amount of data we collect about Clients is very limited. Generally, we only need your contact information, or the information of individual contacts within your organization (such as their names, phone numbers and email addresses) to ensure that our relationship runs smoothly.

  • SUPPLIER DATA:

We don't collect a lot of data on Suppliers. We simply need to ensure that our relationship runs smoothly. We will collect details of our contacts within your organization, such as names, phone numbers and email addresses.

  • WEBSITE USERS

We collect a limited amount of data about our Website users, which we use to help us improve your experience with our Website and manage our services. This includes, for example, information about how you use our Website, the frequency with which you visit our Website, your browser type, the location from which you view our Website. We do not collect and process IP data, therefore no identifiable data. 

 

HOW DO WE COLLECT YOUR PERSONAL DATA?

  • CANDIDATE DETAILS:

We collect personal data from Candidates primarily in two ways, among others:
1. Personal data provided to us by you, the Candidate.
2. Personal data we obtain from other sources

In order to provide a service tailored to you, N-ABLE needs certain information about you. This will enable us to provide you with the best options. There are numerous ways in which you can share information with us. Which way you choose depends on what suits you best. These could include:

  • Leaving your information on N-ABLE's website or through a form, as part of the application process;
  • Mailing your resume
  1. Personal data we obtain from other sources

Among other things, we also obtain personal data about our Candidates from other sources. Depending on the relevant circumstances and applicable local laws and regulations, this could include personal data that could be involved in the following situations, among others:

  1. Your reference person might provide personal information about you, obviously only after your agreement;
  2. Our Clients might share personal information about you with us;
  3. We might also obtain information about you by searching for Candidates on third-party sources, such as on LinkedIn and other similar sites;
  • CLIENT DATA

We collect personal data from Clients primarily directly from you. We share the same goal - ensuring that you obtain the best possible employees for your organization. We receive from you:

  1. Where you proactively contact us, usually by phone or email
  2. Where we contact you, either by phone or email
  3. We might also obtain information about you by searching for Candidates on third-party sources, such as on LinkedIn and other similar sites;
  • SUPPLIER DATA:

We collect personal data from Clients primarily directly from you. We receive from you:

  1. Where you proactively contact us, usually by phone or email
  2. Where we contact you, either by phone or email
  3. We might also obtain information about you by searching for Candidates on third-party sources, such as on LinkedIn and other similar sites;

 

HOW DO WE USE YOUR PERSONAL DATA?

  • CANDIDATE DATA: 

In general, we use Candidates' data for placing Candidates with a client and for subsequent contact etc:

Our main field of activity is, of course, connecting the right Candidates with the right assignments/clients. In the following we have listed in which cases it is possible that we use and process your personal data, for this purpose among others.

  1. Collecting data from you and other sources, such as LinkedIn;
  2. Store (and update as necessary) your information in our database so that we can contact you regarding placement with a client;
  3. Review data about you against potential assignments that we think might suit you;
  4. Sending your information to Clients so that you can be considered for placement with a client;
  5. Allowing you to submit your resume and let us know online which assignments you would like to be considered for for assignments you think might be of interest to you;
  6. Perform our obligations arising from contracts we have entered into with you;
  7. Perform our obligations arising from contracts N-ABLE has entered into with third parties regarding your placement;
  8. Facilitate our billing process;
  9. Meet our legal obligations, including tax obligations
  • SUPPLIER - AND CLIENT DATA:

We will only use your information to store (and update as necessary) your information in our database so that we can contact you regarding placement activities;
 

WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

Where appropriate and in accordance with local laws and regulations, we may share your personal data, in various ways and on various grounds, with the following categories of persons, among others:

  1. Third parties such as outsourced IT providers and document storage providers with whom we have appropriate processing agreements (or similar safeguards) in place
  2. In the case of Candidates: potential clients

 

HOW DO WE PROTECT YOUR PERSONAL DATA?

  1. We make every effort to take all reasonable and appropriate steps to protect the personal information we hold from misuse, loss or unauthorized access. We do this through a number of appropriate technical and organizational measures.
  2. If you suspect misuse or loss of or unauthorized access to your personal information, please notify us immediately.

 

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

  • We will delete your personal data from our systems if we had no meaningful contact with you (or, where applicable, the company for which or with which you work) for two years (or a longer period if we believe in good faith that the law or relevant regulators require us to retain your data). After this period, it is likely that your data is no longer relevant to the purposes for which it was collected.
  • For Candidates whose services are provided through a third-party company or entity, "meaningful contact" with you means meaningful contact with the company or entity providing/providing the services to you. When we are notified by such company or entity that it no longer has a relationship with you, we will not retain your data for more than two years from that time, or, if later, for the period of two years from the time we subsequently had meaningful contact with you directly.
  • When we refer to "meaningful contact" we mean, for example, communication between us (either verbal or written). For example, if you are a Candidate we consider it meaningful contact when you send your updated resume through our website.

 

HOW DO YOU ACCESS, MODIFY OR WITHDRAW PERSONAL DATA YOU HAVE SHARED WITH US?

  • One of the main purposes of the AVG is to protect and clarify the rights of EU citizens and individuals in the EU regarding data protection. This means that you retain several rights regarding your data even after you have given it to us. These are described in more detail below.
  • Right to object: this right allows you to object to our processing of your personal data when we do so for one of the following reasons: (i) our legitimate interests; (ii) to enable us to carry out a task in the public interest or in the exercise of public authority;
  • Right to withdraw consent: Where we have obtained your consent to process your personal data for certain activities, you may withdraw this consent at any time, at which point we will cease the activity for which your consent had been given, unless we consider that there is an alternative ground to justify continued processing of your data for this purpose (think Tax Authorities etc.).
  • Data subject's request for access to data: You can ask us at any time to confirm what information we hold about you and you can ask us to modify, update or delete that information.
  • Right of deletion: In certain circumstances, you have the right to ask us to delete your personal data. When a valid data deletion request is complied with, we will take all reasonable practicable steps to delete the relevant data.
  • The right to limit processing:In certain circumstances, you have the right to ask us to restrict the processing of your personal data. This means that we can only continue to store your data and thus will not be able to carry out any further processing activities .
  • Right to rectification:You also have the right to request that we rectify any inaccurate or incomplete personal data we hold about you.
  • Right to data portability:You have the right, if you wish, to transfer your personal data between controllers.
  • It is important that the personal information we hold about you is accurate and current. Therefore, please keep us informed if your personal information changes during the time we hold your information.

 

ADVERTISEMENT

  • In certain circumstances, we are required to obtain your consent to process your personal data in relation to certain activities.
  • 4(11) AVG implies consent: "any freely given, specific, informed and unambiguous expression of will by which the data subject signifies, by means of a statement or an unambiguous active act, his or her consent to the processing of personal data relating to him or her."

In ordinary human language, this means:

o You must give us your consent freely, without us pressuring you in any way;

o You need to know what you are agreeing to, so we make sure we give you enough information;

o You must give your consent by clear active action
